Article 1 – Definitions
In these terms and conditions:
- Reflection period: the period within which the consumer can make use of his right of withdrawal;
- Consumer: the person who purchases products from Zuidsoost 020;
- Day: calendar day;
- Transaction period: a distance contract with regards to a series of products and/or services, the delivery and/or purchase obligation of which is spread over time;
- Durable data carrier: all means to store information sent personally to the consumer or to Zuidoost 020 in a way that allows future consultation or use during a period that is aligned with the purpose for which the information is intended, and that allows unaltered reproduction of the stored information;
- Right of withdrawal: the possibility for the consumer to cancel the purchase within the cooling-off period;
- Company: the natural or legal person who offers products and/or services to consumers at a distance: Zuidoost 020;
- Contract (distance): an agreement if the consumer buys a product via the internet, telephone or with order forms from Zuidoost 020, whereby there is no direct contact between the consumer and Zuidoost 020;
- Withdrawal model form: the return form can be requested via info@zuidoost020.nl;
- Communication (distance): means that can be used to conclude an agreement, without the consumer and Zuidoost 020 having had direct contact;
- Terms & Conditions: the present Terms and Conditions of the Company;

Article 3 – Applicability
- These terms and conditions apply to every offer from Zuidoost 020 and to every distance contract concluded between Zuidoost 020 and a consumer for shipments within the Netherlands.
- Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer.
Article 4 – Offers
- If an offer has a limited period of validity, this will be explicitly stated in the offer.
- The offer is without obligation. Zuidoost 020 is entitled to change and adjust the offer.
- All products contain a complete and accurate description that is sufficiently detailed for the consumer to make a proper assessment of the product. All photos are a true representation of the products offered. Mistakes or errors are not binding on Zuidoost 020.
- All images, specifications and data in the offer are indicative and cannot give rise to compensation or dissolution of the agreement.
- Images accompanying products are a true representation of the products offered. Zuidoost 020 cannot guarantee that the displayed colors exactly match the real colors of the products.
- Each product / offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the product / offer.
Article 5 – The agreement
- The agreement is concluded at the moment of acceptance by the consumer of the offer and compliance with the corresponding conditions.
- If the consumer has accepted the offer electronically, Zuidoost 020 will immediately confirm receipt of the acceptance of the offer electronically. As long as the receipt of this acceptance has not been confirmed by Zuidoost 020, the consumer can dissolve the agreement.
- If the agreement is concluded electronically, Zuidoost 020 will take appropriate technical and organizational measures for a secure electronic transfer of data and ensure a secure website. Zuidoost 020 takes appropriate security measures for electronic payments.
- Zuidoost 020 can – within legal frameworks – inform itself whether the consumer can meet his payment obligations, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, Zuidoost 020 has good reasons not to enter into the agreement, it is entitled to refuse an order or request with reasons, or to attach special conditions to the implementation.
- Zuidoost 020 will send the following information to the consumer with the product or service, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable data carrier:
a. the conditions under which and the manner in which the consumer can make use of the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;
b. the information about warranties and existing after-sales service;
c. the price including taxes of the product and shipping costs, as well as the method of payment;
d. the return form if the consumer has a right of withdrawal.
- Every agreement is entered into under the conditions precedent of sufficient availability of the relevant products.
Article 6 – Right of withdrawal
- When purchasing products, the consumer has the option of dissolving the contract without giving reasons during 14 days. This cooling-off period starts on the day after receipt of the product by the consumer. This applies to non-personalized products and also products from the standard collection.
- During the cooling-off period, the consumer will handle the product and the packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he makes use of his right of withdrawal, he will return the product with all accessories supplied and – if reasonably possible – in the original condition and packaging to Zuidoost 020, in accordance with the reasonable and clear instructions provided by Zuidoost 020.
- If the consumer wishes to make use of his right of withdrawal, he is obliged to make this known to Zuidoost 020 within 14 days after receipt of the product. The consumer must make this known by means of the model form. After the consumer has indicated that he wishes to make use of his right of withdrawal, the customer must return the product within 14 days. The consumer must prove that the delivered goods have been returned on time, for example by means of proof of dispatch.
Article 7 – Costs in case of withdrawal
- If the consumer makes use of his right of withdrawal, the costs of return will be covered by the consumer.
- If the consumer has paid an amount, Zuidoost 020 will refund this amount as soon as possible, but no later than 14 days after cancellation. This is subject to the condition that the product has already been received back by the web retailer or that conclusive proof of complete return can be submitted. Reimbursement will be made via the same payment method used by the consumer, unless the consumer gives explicit permission for a different payment method.
- In the event of damage to the product due to careless handling by the consumer himself, the consumer is liable for any reduction in value of the product.
- The consumer cannot be held liable for the depreciation of the product if Zuidoost 020 has not provided all legally required information about the right of withdrawal, this must be done before the purchase agreement is concluded.
Article 8 – Pricing
- During the period of validity stated in the offer, the prices of the products and/or services offered will not be increased, except for price changes as a result of changes in VAT rates.
- The prices stated in the offer of products or services include VAT.
- All prices are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors. In the event of printing and typesetting errors Zuidoost 020 is not obliged to deliver the product according to the incorrect price.
Article 9 – Delivery and execution
- Zuidoost 020 will take the greatest possible care when receiving and executing orders for products.
- The place of delivery is the address that the consumer has made known to Zuidoost 020.
- Zuidoost 020 will execute accepted orders expeditiously but at the latest within 10 days, unless a different delivery period has been agreed. If the delivery is delayed, or if an order cannot or only partially be executed, the consumer will be notified of this no later than 7 days after he has placed the order. In that case, the consumer has the right to dissolve the agreement without costs. The consumer is not entitled to compensation.
- All delivery times are indicative. The consumer cannot derive any rights from any stated terms. Exceeding a term does not entitle the consumer to compensation.
- The risk of damage and/or loss of products rests with Zuidoost 020 until the moment of delivery to the consumer or a pre-designated representative made known to Zuidoost 020, unless expressly agreed otherwise.
Article 10 – Payment
- Unless otherwise agreed, the amounts owed by the consumer must be paid within 7 working days after the start of the cooling-off period.
- The consumer is obliged to immediately report inaccuracies in payment details provided or stated to Zuidoost 020.
- When selling products to consumers, the consumer may never be obliged to pay more than 50% in advance in the general terms and conditions. When advance payment has been stipulated, the consumer cannot assert any rights regarding the execution of the relevant order or service(s) before the stipulated advance payment has been made.
- In the event of non-payment by the consumer, Zuidoost 020 has the right, subject to legal restrictions, to charge the reasonable costs made known to the consumer in advance.
- If the consumer does not meet his payment obligation(s) in time, after he has been informed by Zuidoost 020 of the late payment and Zuidoost 020 has granted the consumer a period of 14 days to still meet his payment obligations, if payment is not made within this 14-day period, the statutory interest will be due on the amount still due and Zuidoost 020 will be entitled to charge the extrajudicial collection costs incurred by it. These collection costs amount to a maximum of: 15% on outstanding amounts up to € 2,500; 10% on the next € 2,500.= and 5% on the next € 5,000.= with a minimum of € 40.=. Zuidoost 020 may deviate from the stated amounts and percentages to the benefit of the consumer.
Article 11 – Complaints procedure
- Zuidoost 020 has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
- Complaints about the implementation of the agreement must be submitted fully and clearly described to Zuidoost 020 within a reasonable time, after the consumer has discovered the defects.
- Complaints submitted to Zuidoost 020 will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Zuidoost 020 will respond within the period of 14 days with a notice of receipt and an indication when the consumer can expect a more detailed answer.
- The consumer must give Zuidoost 020 at least 4 weeks to resolve the complaint in mutual consultation. After this period, a dispute arises that is subject to the dispute settlement procedure.
Article 12 – Disputes
Only Dutch law applies to agreements between Zuidoost 020 and the consumer to which these terms and conditions apply.
Article 13 – Final provisions
Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.
Article 14 – Intellectual property rights
All intellectual property rights, such as trademarks and copyrights in items on the Site remain with Zuidoost 020 and/or its subsidiaries or licensors. The Site and its content (including but not limited to logos, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site) may not be used, including copying or storing in whole or in part, communication to the public or distribution without the express written permission and/or license of Zuidoost 020.
Zuidoost 020 grants users a limited license to access its Site. This does not include the right to download (other than the page caching) or modify the Site or any portion of it, except if Zuidoost 020 provides express written consent for such an action. This license does not include any re-sale or commercial use of the Site or its contents; any collection and use of any product listings, images, descriptions or prices; any derivative use of the Site or its contents; any downloading or copying of account information for benefit of another merchant; or any use of data mining, bots or similar data gathering and extraction tools. The Site or any portion of it may not be re-produced, duplicated, sold, re-sold, copied, visited or otherwise exploited for any commercial or non-commercial purpose without our express written consent. You may not frame or use any framing techniques to enclose any of the trademark, logo or any proprietary information (including page layout, images, text or form) of Zuidoost 020 or our affiliates without express written consent. You may not use any meta tags or any other “hidden text” Zuidoost 020’s name or our trademarks without Zuidoost 020’s express written consent. Any unauthorised use terminates the permission or license granted by Zuidoost 020 Subject to the next sentence, you are granted a limited, non-exclusive, and revocable right to create any hyperlink to the zuidoost020.nl homepage as long as the link does not portray the services or products of Zuidoost 020 or its affiliates in a false, derogatory, misleading, or otherwise offensive matter, or as you having the right of ownership of the same in any form, or for inclusion in any context that is illegal, offensive, or otherwise harmful to our business interest. You may not use our trademark, or any Zuidoost 020 logo or other proprietary graphic as part of a hyperlink without express written consent and our acceptance, and by this limited license we do not warrant or represent in any way that any use of such license does not violate a third party’s rights.
